البتراء للتسويق العقاري منصة متخصصة في التسويق العقاري وعرض الفرص العقارية وربط المستخدمين بالعقارات أو الجهات ذات الصلة، وذلك وفقًا للأنظمة والقوانين المعمول بها في جمهورية مصر العربية.
يقر المستخدم بأنه:
كامل الأهلية القانونية لإبرام التصرفات والتعاقدات.
يستخدم الموقع لأغراض مشروعة فقط.
يقدم بيانات صحيحة ودقيقة ومحدثة عند التسجيل أو التواصل أو طلب الخدمة.
ويحق للمنصة تعليق أو تقييد أو إنهاء استخدام أي حساب أو طلب إذا تبيّن وجود بيانات غير صحيحة أو استخدام مخالف للقانون أو لهذه الشروط.
يلتزم المستخدم أو المُعلن بأن تكون جميع البيانات والمعلومات والصور والمستندات المتعلقة بالعقار:
صحيحة ودقيقة وغير مضللة.
غير مخالفة للقوانين أو الحقوق أو الأنظمة العامة.
خالية من أي ادعاءات كاذبة بشأن الملكية أو السعر أو المواصفات أو الوضع القانوني للعقار.
وتحتفظ المنصة بحق رفض أو تعديل أو حذف أي إعلان أو محتوى يخالف هذه الشروط أو يضر بمصداقية المنصة أو المستخدمين.
تبذل المنصة جهدًا معقولًا في عرض المعلومات العقارية بشكل واضح ومنظم، إلا أن مسؤولية التحقق النهائي من:
الملكية أو الصفة القانونية،
التراخيص والموافقات،
المساحة والموقع،
الحالة الفنية أو القانونية للعقار،
صلاحية التعاقد والتنفيذ،
تقع على عاتق الأطراف المعنية قبل إتمام أي معاملة نهائية.
ما لم يُذكر خلاف ذلك، يجوز عرض الأسعار أو الرسوم أو المقابل المالي على المنصة بالدولار الأمريكي (USD) أو ما يعادله بالعملة المحلية.
وفي حال السداد أو التسوية بالجنيه المصري أو بأي عملة محلية أخرى، يتم احتساب المقابل وفق سعر الصرف السائد أو المرجعي المعتمد وقت السداد، ويجوز للمنصة أو مزود الخدمة اعتماد السعر المعلن من البنك المركزي المصري أو من الجهة المصرفية/المالية المعتمدة وقت تنفيذ العملية، ما لم يتم الاتفاق كتابيًا على آلية مختلفة.
تُقبل وسائل الدفع التي تعتمدها المنصة من وقت لآخر. ويُعد إتمام عملية الدفع موافقة من المستخدم على قيمة العملية والرسوم المرتبطة بها – إن وجدت – وفقًا لما هو موضح قبل الإتمام.
ما لم يوجد اتفاق خاص أو نص إلزامي واجب التطبيق:
لا يحق للمستخدم المطالبة باسترداد أي مبالغ تم سدادها مقابل خدمات تم تنفيذها فعليًا.
تخضع طلبات الإلغاء أو الاسترداد لطبيعة الخدمة ومرحلة تنفيذها وأي رسوم مصرفية أو تشغيلية أو إدارية ترتبت عليها.
إذا وافقت المنصة على استرداد أي مبلغ، فيجوز خصم الرسوم البنكية أو رسوم التحويل أو المصروفات الإدارية المستحقة.
أي بيع أو إيجار أو حجز أو تحويل حق أو اتفاق نهائي يتعلق بعقار يجب أن يتم من خلال:
مستندات واضحة،
ومراجعة قانونية مناسبة،
والتحقق من هوية الأطراف وصفاتهم،
والتحقق من المستندات والحقوق والالتزامات المرتبطة بالعقار.
ولا يُعد عرض العقار على المنصة وحده ضمانًا لإتمام الصفقة أو لصحة جميع بياناتها أو خلوها من الموانع القانونية.
يُحظر على المستخدم:
نشر بيانات أو صور أو معلومات مضللة أو غير حقيقية.
انتهاك حقوق الملكية الفكرية أو الخصوصية أو سمعة الغير.
استخدام الموقع في الاحتيال أو الإضرار أو التشهير أو جمع البيانات بطرق غير مشروعة.
محاولة اختراق الموقع أو تعطيله أو إساءة استخدامه بأي وسيلة تقنية أو قانونية.
جميع الحقوق المتعلقة بالموقع، بما في ذلك الاسم التجاري، العلامات، النصوص، التصاميم، الصور، الشعارات، قواعد البيانات، والمحتوى البرمجي، مملوكة للمنصة أو للمرخص لهم لها، ولا يجوز استخدامها أو نسخها أو إعادة نشرها أو استغلالها دون موافقة خطية مسبقة.
تلتزم المنصة بالتعامل مع البيانات الشخصية وفقًا للسياسات المعمول بها والإطار القانوني الواجب التطبيق في جمهورية مصر العربية. ويجوز جمع ومعالجة البيانات اللازمة لتقديم الخدمة، والتواصل مع المستخدم، وتحسين تجربة الاستخدام، والامتثال للالتزامات القانونية والتنظيمية.
وباستخدام الموقع، يوافق المستخدم على جمع ومعالجة بياناته في الحدود اللازمة لتقديم الخدمة وتنفيذ الطلبات والوفاء بالالتزامات النظامية.
يوافق المستخدم على أن الإشعارات والمراسلات والموافقات الإلكترونية الصادرة عبر الموقع أو البريد الإلكتروني أو وسائل الاتصال المعتمدة تُعد منتجة لآثارها القانونية متى أجاز القانون ذلك.
إلى الحد الذي يسمح به القانون، لا تتحمل المنصة المسؤولية عن:
أي خسائر غير مباشرة أو تبعية أو فائتة الربح،
أو أي أضرار ناشئة عن قرارات المستخدم الاستثمارية أو التعاقدية،
أو أي نزاع ينشأ بين الأطراف بشأن عقار أو دفعة أو التزام أو مستند،
أو أي تأخير أو تعذر خارج عن الإرادة.
كما لا تضمن المنصة التوافر الدائم للموقع دون انقطاع أو خلوه من الأخطاء التقنية بشكل مطلق.
يوافق المستخدم على تعويض المنصة وإبراء مسؤوليتها عن أي مطالبات أو خسائر أو نفقات أو أضرار تنتج عن:
مخالفته لهذه الشروط،
أو مخالفته للقانون،
أو تقديمه بيانات أو مستندات غير صحيحة،
أو تعديه على حقوق الغير.
تحتفظ المنصة بحق تعديل هذه الشروط والأحكام في أي وقت. ويُعد استمرار المستخدم في استخدام الموقع بعد نشر التعديلات موافقةً ضمنية عليها.
تخضع هذه الشروط والأحكام وتُفسر وفقًا لقوانين جمهورية مصر العربية، وتختص المحاكم المصرية بنظر أي نزاع ينشأ عنها أو يتعلق بها، ما لم يتم الاتفاق كتابةً على وسيلة تسوية نزاع أخرى جائزة قانونًا.

Petra Real Estate Marketing is a real estate marketing platform that lists property opportunities and facilitates communication between users and relevant parties, in accordance with the laws and regulations applicable in the Arab Republic of Egypt.
By using the platform, the user represents and warrants that they:
have full legal capacity to enter into binding arrangements;
use the website for lawful purposes only; and
provide true, accurate, and up-to-date information.
The platform reserves the right to suspend, restrict, or terminate any account or request where false information or unlawful use is identified.
Users and advertisers must ensure that all property-related data, documents, images, and descriptions are:
accurate and not misleading;
compliant with applicable laws and public order; and
free from false claims regarding ownership, pricing, specifications, or legal status.
The platform reserves the right to reject, amend, remove, or suspend any listing or content that violates these Terms or harms the platform’s integrity.
The platform makes reasonable efforts to present property information clearly and professionally. However, final verification of:
ownership or legal title,
permits and approvals,
area and location,
technical and legal status,
contractual validity and enforceability,
shall remain the responsibility of the relevant parties before completing any final transaction.
Unless otherwise stated, prices, fees, or other monetary amounts on the platform may be displayed in United States Dollars (USD) or their equivalent in local currency.
Where payment is made in Egyptian Pounds or any local currency, the equivalent amount shall be calculated based on the prevailing or reference exchange rate at the time of payment. The platform or service provider may rely on the rate published by the Central Bank of Egypt or the relevant approved banking/financial entity on the transaction date, unless otherwise agreed in writing.
Payments may be made using the payment methods approved by the platform from time to time. By completing a payment, the user agrees to the transaction amount and any related fees, if applicable, as disclosed before completion.
Unless otherwise agreed or required by mandatory law:
amounts paid for services already performed are non-refundable;
cancellation and refund requests are subject to the nature of the service, the execution stage, and any banking, processing, or administrative fees incurred; and
where a refund is approved, the platform may deduct bank fees, transfer fees, and administrative charges.
Any sale, lease, reservation, assignment, or final property-related transaction should be completed through:
clear documentation,
appropriate legal review,
verification of identity and authority of the parties, and
review of all relevant property documents, rights, and obligations.
A property listing on the platform alone does not constitute a guarantee of transaction completion or confirmation of the legal sufficiency of all listing details.
Users may not:
publish false, misleading, or inaccurate information;
infringe intellectual property, privacy, or third-party rights;
use the platform for fraud, abuse, defamation, or unlawful data collection; or
attempt to hack, disrupt, disable, or misuse the platform in any manner.
All rights related to the platform, including the trade name, trademarks, text, designs, logos, images, databases, and software content, are owned by the platform or its licensors and may not be copied, reused, republished, or exploited without prior written consent.
The platform shall process personal data in accordance with its applicable policies and the legal framework in force in the Arab Republic of Egypt.
